That's not a Good Serve! (Uhh, Ma'am. That is a good serve.)
So here I am again at one of our very first client's Mobile Home Park. I go
here every month. I had another Unlawful Detainer (eviction notice) to
serve on a mobile home owner who did not want to pay the rent for the
land on which her home rested.
I rapped on the door and was greeted by a rather large, angry woman.
I hid my fear from her.
I asked, "Are you BobbieJoSallyMae?"
"Yes," she responded.
I told her I had some papers for her and extended my hand forward with
said papers therein.
As I reached forward, she pulled her arms up and back-sorta like what
you would see in a B-Cowboy movie when the stage coach gets held up.
Her boyfriend asked if she was "just gonna stand there or are ya gonna
take them papers."
She looked at me with her hands reaching for the sky and said, "if I don't
take 'em it's not a good serve." I deduced she had been talking to her bar
buddies about legal issues and was now up on Civil Procedure.
I said, "Actually, Ma'am, that is not the case." I dropped the papers at her
feet and said "You have been served."
As I walked away she kept yelling at me. "That's not a good serve! That's
not a good serve!"
My business partner brought my affidavit to the court the next morning.
The clerk of court read the comments and stated, "This is not a good
serve. The judge is going to toss this." Shayne politely rebutted that it
would be fine and left the affidavit with the clerk.
When the Housing Court date had come and gone, I called the client to
see if everything went OK. (Of course it did, why else would you be
reading this?)
Regarding legal advice? You get what you pay for. For time eternal,
man has sought counsel whilst swilling the spirits. Last I checked,
however, "Johnny, Jim & Bud" was NOT a real law firm.
