Collections and Process Serving Stories

I got a call from a woman who used to rent from a less than upstanding
multi-unit apartment owner. I had a personal stake in this as I had won a
judgment against his brother for serves gone unpaid, and jumped at the
chance to serve him. I was told that the sheriff and another MAJOR
process serving company each had about 5 attempts on this guy with no
success.
I had never seen this individual. But I am clever.
I went to his home about 8:45 one evening and knocked on the door. I
could see a man inside who looked very much like the brother I had done
some work for. He shouted through the door that Mr. So and So was not
here. He disappeared in a hallway and I began knocking more loudly. He
came back and told me to leave or he would call the police. I said to do so
and went to my car to warm up (it was 8 below).
A County Sheriff showed up, asked me what I was doing and if I had been
drinking. I showed him the papers and he told me to sit tight and went to
the door. Another city Police Officer pulled up behind me on the other
rear flank of my vehicle. I was not going anywhere.
The Sheriff signaled me to come to the door. My serve pointed at his
watch and said, "you can't serve me, it is after 9pm." This from a guy who
should know better than that. Regarding service at his apartments, the
statute says "...and that one attempt be made between 6pm and 10pm.
The Sheriff called in and verified the statute, asked my serve if he was Mr.
So and So, which he then admitted, and gave me the nod.
"You have been duly served."
Other than Quaker Oats, nothing warms your heart on a Minnesota winter
night like a difficult serve well done.
